JULIE: (reading) Mental stability, crossword enthusiast --

KIRSTEN: Must have own money, love horses and be plastic surgery free... You didn't leave a lot of wiggle room here, Summer.

SUMMER: That's because he had nothing in common with his first two wives, and both of them left. It's not fair to him. Or me.

JULIE: (a long beat) Okay, then. We'll see what we can do.

SUMMER: Thanks, you have no idea how much this means. I'm going to go see if my dad's actually coming home tonight...

And as Summer lets herself out...

KIRSTEN: Julie, what are you going to do?

JULIE: I don't know. Is it possible I'm not enough woman for him? Do I really need to be all these things?

KIRSTEN: That is not what I meant. You will never be any of those things. Okay, blonde, maybe. But... (off the list) Fluent in Italian? Not so much. Summer needs to know the truth.

And off Julie...

EXT. CRAPPY BREA HOUSE -- NIGHT (N2)

Ryan and Sadie exit the car, cross a burned out lawn to the front door. A TV flicker can be seen inside, someone's home.

RYAN: You ready?

Sadie nods, takes a deep breath. Ryan knocks.

MAN'S VOICE: (O.S.) Who is it?

SADIE: It's Sadie. Sadie Campbell. (off his silence) Uncle Jack?

The door opens, revealing a large, angry-looking man.

SADIE: Uh, hi. We're looking for Jack Harper. But I see that you are not him --

ANGRY LOOKING MAN: He in some kind of trouble?

RYAN: (shares a look with Sadie) No. No trouble.

SADIE: Yeah. Good news, actually.

RYAN: Great news --

ANGRY LOOKING MAN: (softening) Too bad. I frickin' hate that guy.

RYAN: (looks to Sadie) Okay there is no good news. News is all bad.

SADIE: He owes someone money and we're trying to collect.

ANGRY LOOKING MAN: (going to close the door) Good luck with that.

SADIE: (stopping him) Yeah, we will need good luck. And information. If you have any.

ANGRY LOOKING MAN: (beat, considering) He moved to Indio. That's all I know.

RYAN: No forwarding address? Phone?

ANGRY LOOKING MAN: No one 'round here was looking to keep in touch.

SADIE: Okay. Well, thanks for your help.

ANGRY LOOKING MAN: (shutting the door) You find Jack Harper, you won't be thanking me...

Ryan and Sadie turn and head for the car.

RYAN: Indio. That's something. We can go home and figure it out --

SADIE: I'm not going home. Not until I find him.

RYAN: Then neither am I.

SADIE: Indio's two hours into the desert. We probably won't even be able start looking until the morning.

RYAN: Then we spend the night.

SADIE: (Marissa? The Cohens?) No one'll miss you...?

RYAN: I'll make some calls.

And off Ryan Atwood, Road Warrior...

INT. FUNKY KOREAN BBQ -- NIGHT (N2)

Dark little hole in the wall with a killer menu. We follow Dr. Roberts to a booth, where a woman sits, dressed in white, signature Sharon Stone bitch bun, and a long menthol 100 cigarette. She's doing the Times crossword puzzle -- it's Julie.

JULIE: Bona Noce, Foctor. What's a thirteen letter word for secretive?

DR. ROBERTS: Surreptitious... I don't think you can smoke in here...

She stubs out her cigarette, folds up the paper.

DR. ROBERTS: What is all this?

JULIE: You like it? Because tonight is all about you.

DR. ROBERTS: I didn't know you did the crossword...

Back at the host stand -- Taylor is ordering from the Korean host, a menu in her hand, her cell phone pressed to her ear.

TAYLOR: They're out of Bibimbop...

KOREAN HOST: Yes, all gone.

TAYLOR: (to the host) How about Bulgogi?

KOREAN HOST: Two order?

TAYLOR: (in Korean) Yes, extra sauce on the side. (then into phone) Next time let me call in the order Mom... I know, that's why they call it Korean barbecue. Goodbye... (hangs up, exasperated, in Korean) Mothers.

*

SETH: Hold on now, this kind of broad reveal requires independent confirmation --

TAYLOR: Fine, go see for yourselves. I know where their next tryst is going to be. (beat, then shamefully) It's your dad's most unspeakable fantasy.

And off Summer, her ick-factor hitting eleven...

INT. "BIG H" BAIL BONDS OFFICE -- DAY (D3)

A nasty looking bondsman sits at a desk as a mulleted bounty hunter cleans his sidearms. It's a heartwarming scene. They look up to see Ryan and Sadie enter --

RYAN: Jack Harper in?

BONDSMAN: He's out on job. You need a bond, I can take care of it. Got a valid license...?

RYAN: We don't need a bond. We're looking for Harper.

SADIE: When do you expect him back?

BONDSMAN: Who wants to know?

SADIE: His son, for starters.

BONDSMAN: Get outta here.

RYAN: We don't mind waiting.

The bondsman stands up -- he's huge. Almost as huge as the bounty hunter who starts making his way over.

BONDSMAN: I got authority to protect this property with lethal force, know what that means?

RYAN: Means we'll be in the car.

And with that, Ryan and Sadie head back out. The bondsman watches them, then picks up the phone.

INT. MATT RAMSEY'S APARTMENT -- DAY (D3)

Marissa stands with Sandy, glances over to Detective Warner (40s) on the couch, uniform cop behind him. Intimidating.

SANDY: It's gonna be fine. You've done nothing wrong.

MARISSA: Doesn't feel that way.

SANDY: I'll be right there with you...

Marissa nods numbly and they cross, sit.

DETECTIVE WARNER: Now just relax, and answer my questions as truthfully as possible. (off her nod) Was your friend Johnny a big drinker?

MARISSA: No.

DETECTIVE WARNER: But he was drinking that night? (off her nod) Any idea why?

SANDY: You're asking her to speculate --

MARISSA: Maybe he just wanted to have a good time.

DETECTIVE WARNER: Maybe. But do you know if there was anything going on in his life that would've made him want to drink? (off her silence) Yes or no? It's okay to say no.

spoilers for episode seventeen --- The Journey
JULIE: Summer, I totally understand. And we are nowhere near getting engaged. Trust me.

Summer looks at her, trying to decide if she can believe her.

SUMMER: You're serious?

JULIE: Of course. Now, does Marissa know?

SUMMER: Not yet.

JULIE: Well, I guess I'd better tell her. (looks a tickets) And buy a new bikini.

She sees Summer looking at her and smiles.

INT. NON-DESCRIPT ROOM -- AFTERNOON (D3)

Sandy enters. A man, we only see his face, steps in his way.

SANDY: I'm here to see Dawn Atwood.

MAN: Third one down.

The man steps back. He's wearing a cop's uniform. Sandy's in the visiting area of a jail. He sits in a booth across from Dawn, who's dressed in a jumpsuit. A piece of plexiglass with little holes in it is between them.

SANDY: Hey, Dawn.

DAWN: Sandy, what're you doing here?

SANDY: You forget? Tomorrow's Ryan's eighteenth birthday. I was gonna invite you to a party, but...

He looks around as if to say, "you're indisposed." Dawn is overcome for a moment, then pulls herself together.

*

VOLCHOK: Just relax, okay? (she calms a little) Look, after seeing you on that cliff, I got worried. I wanted to -- check up on you. That's all.

Marissa looks at him, not quite sure how to take this.

MATT: Marissa!

He hurries up. Volchok lets go of Marissa's wrist.

MATT: What's going on? Is this guy bothering you?

VOLCHOK: Who's this? Your new protector?

MATT: I think you'd better just walk away.

VOLCHOK: Or what? You're gonna hit me with your cell phone?

MARISSA: Stop it!

VOICE: (O.S.) What's going on here?!

A cop walks up.

MATT: Officer, this guy was bothering her, so I stepped in.

VOLCHOK: (mincing voice) Yes, officer, save us --

COP: Shut it.

VOLCHOK: Gimme a break, I wasn't --

COP: I said shut it! (to Matt, Marissa) You two get out of here. (to Volchok) You -- I wanna see some I.D.

MATT: Come on.

He leads Marissa off. She looks back at Volchok, who glances at her, then insolently pulls out his I.D. and gives it to the cop. Off Marissa, feeling bad.

EXT. JULIE'S MOBILE HOME -- NIGHT (N3)

Ryan approaches the trailer door, holding the invite. He looks at it, then raises his hand to knock. He pauses. Lowers his hand. He puts the invite back in his pocket, and walks away.

End of Act Two.

*

EXT. BEACH - PARKING LOT -- DAY (D4)

Marissa approaches a pair of surfers putting their boards on a car. One is Volchok's buddy with the flaming heart tattoo.

MARISSA: Hi, excuse me, you're friends with Volchok, right?

TATTOOED SURFER: No.

MARISSA: Okay, I know you are. You were there the night you guys kinda kidnapped me. Not that I'm still angry, I just need to find him. Please.

TATTOOED SURFER: (considers, then) I haven't seen him in a while. Ever since Harper died he's been acting weird. But you could try this drywall guy he used to work for. Got a pen?

MARISSA: Oh, sure.

Marissa hands him a pen. He takes her hand and starts writing a number on it. Marissa tries to smile, act cool.

INT. YACHT CLUB -- DAY (D4)

Julie, with contained excitement, sits at a table. Dr. Roberts enters, glances around nervously before sitting.

DR. ROBERTS: Julie, I was glad to get your message. But isn't this a little --

JULIE: Public, I know. But I'm afraid the cat's out of the bag. The girls know.

DR. ROBERTS: What? How?

*

SANDY: (nothing) Dawn?

The room is empty. His eye catches sight of an envelope on the bed. He picks it up. It says: "RYAN." Sandy sighs, looks around the empty room. Taking the envelope, he leaves.

EXT. JULIE'S MOBILE HOME -- AFTERNOON (D4)

Ryan, dressed for the party, knocks on the trailer door. No one answers. He opens it.

INT. JULIE'S MOBILE HOME -- CONTINUOUS

Ryan enters, looking around.

RYAN: Marissa?

No one answers. He finds a CD labeled, "Ryan, Happy 18th." Looking up, his eye rests on a picture of him and Marissa.

EXT. MODEL HOME -- AFTERNOON (D4)

Looking at Volchok's van, Marissa walks past it. Then stops, catching sight of the house. She stops, staring at it.

VOICE: (O.S.) Need some help?

Marissa looks to the side. The foreman, in work clothes, is getting tools from the back of a beat-up pick up truck.

MARISSA: Oh, yeah. I'm looking for Kevin Volchok.

FOREMAN: Inside.

Marissa nods, looks again at the house.

FOREMAN: You okay?

MARISSA: This house just looked familiar.

FOREMAN: McMansions -- they all look the same to me.

MARISSA: Yeah, I guess. Thanks.

*

As she starts to turn, we see a flicker of doubt cross Volchok's face like he's gonna call her back, then --

FOREMAN: (O.S.) Volchok!

The foreman is at the bottom of the stairs.

FOREMAN: What'd I tell you about smoking in here?! The owner comes in and sees you -- place already burned down once!

Then it hits Marissa. She looks around, realizing. This is the MODEL HOME.

Marissa: Oh my God.

FLASHBACK -- The nicer memories of the Model Home come back to her. Pulling up to the house with Ryan and Seth. Sitting by the pool with Ryan as Seth skated. Ryan lighting candles upstairs...

The music from the CD she made him plays, bridging to...

INT. JULIE'S MOBILE HOME -- SAME TIME (D4)

Ryan in the trailer, listening to the same song, his hand moving away from the stereo.

INT. MODEL HOME -- SAME TIME (D4)

The song continues. Volchok sees Marissa sway, stunned, start to lose her balance.

VOLCHOK: Hey, are you all right?

Off Marissa's face -- FLASHBACK -- the more violent memories from the Model Home. Ryan yelling at her "Get out!" Ryan and Luke fighting. The fire starting...

Present time -- Marissa reaches behind her for a banister, misses it. She falls. Volchok lunges for her, but is too late. She falls down the marble stairs.

INT. JULIE'S MOBILE HOME -- SAME TIME (D4)

Ryan, listening to the song, puts his face in his hands.

*

INT. BAIT SHOP -- NIGHT (N4)

We're on a poster-sized photo of a cowboy onto which Ryan's face has been somewhat badly transposed. Seth and Ryan are looking at it. Ryan is somewhere between shock and horror.

SUMMER: Two homeless guys just got in a fight over the crudites and knocked down Scientist Ryan.

SETH: (to Ryan, shrugs) I met 'em outside Ralph's. They seemed cool enough.

Kirsten approaches, putting away her phone.

KIRSTEN: I got a message from Sandy. His plane's landed.

SETH: Look at that, another person you know. This is great, right?

A guy carrying a drink bumps into Ryan. He looks from him to the photo of Cowboy Ryan. He grins.

GUY WITH DRINK: Sorry, pardner.

Laughing to himself, the guy moves off. Seth tries to smile.

INT. JULIE'S MOBILE HOME -- NIGHT (N4)

Door opens. Volchok helps Marissa enter. She's got ice on her forehead where there's a bruise coming up.

MARISSA: Thanks, I'm really okay.

He helps her to the couch.

VOLCHOK: Still think the hospital's a good idea.

MARISSA: I'm fine.

VOLCHOK: Gimme your ice pack.

She hesitates, still not trusting him.

VOLCHOK: You need new ice.

Spoilers for episode eighteen, The Undertow...

*

RYAN: She's just a girl who used to go to Harbor.

SADIE: Don't worry, Ryan. I'm not gonna get all possessive. I mean, we danced at your birthday party. It's not like we're a couple.

RYAN: Jess is just a friend. Barely even that. And I'd tell you the whole story, but...

SADIE: You'd rather not. That's cool too. Just know that if you want to tell me about the mysterious Jess and how she connects to a toy Camaro, I will listen. Without judgement. Or you can keep it to yourself. Both are fine with me. (then, off Ryan's pause) I better get back. Dry-walling calls.

She walks out. Ryan looks after her, wants to open up to her, but can't...

INT. NEWPORT GROUP -- DAY (D2)

Sandy is sitting at his desk when Henry Griffin walks in.

SANDY: Henry. I didn't know you were stopping by.

HENRY GRIFFIN: I hope you don't mind.

SANDY: Not at all. Let me get Matt in here.

HENRY GRIFFIN: Uh, I'd rather you didn't.

Sandy drops the phone. Smells trouble. As Henry sits...

SANDY: Well, that doesn't sound good.

HENRY GRIFFIN: The board called an impromptu meeting yesterday. There's been some... complaints about your partner.

SANDY: Complaints?

HENRY GRIFFIN: Rumors. Hooker parties at his house. Booze, drugs. People are starting to get uncomfortable.

SANDY: Well, he and I have been through this before. I'll talk to him again. Make sure he cleans up his act.

HENRY GRIFFIN: I don't think you understand, Sandy. The board didn't sign on to do business with some Lothario who's going to blow their money in strip joints.

SANDY: Look, Matt's no saint, but he worked his ass off on this project. I'm not taking him off it.

HENRY GRIFFIN: Then I'm afraid we can't go forward with the hospital.

SANDY: You gotta be kidding.

HENRY GRIFFIN: You have to make a choice, Sandy. Either you lose Ramsey or you lose the hospital. (then) Take your time. We'll talk in a few days.

INT. COHEN HOUSE - KITCHEN -- EARLY EVENING (N2)

Seth comes in to find Ryan making himself a sandwich.

*

SUMMER: (to the waitress) Is my order ready?

TAYLOR: Lips aren't chapped. No love bites on the neck. Plus your voice isn't at all hoarse from screaming...

WAITRESS: Pancakes to go?

SUMMER: That's me. See ya, Taylor.

TAYLOR: Wait! I can help.

Off Taylor, watching her go -- frustrated, wanting to help...

INT. JOHNNY'S HOUSE -- DAY (D3)

Ryan stops by to find Sadie painting.

RYAN: Hey.

SADIE: Grab a brush. We're in the home stretch here.

He picks up a brush. Turns to her before he uses it.

SADIE: So, thought maybe I'd see you last night.

RYAN: I got tied up.

SADIE: More mystery, I see.

RYAN: Look, I was distracted for a few days. But I'm fine now. (then, with a smile) I'm all yours.

SADIE: Okay, then. You're forgiven. But in exchange for your silence, I demand a dinner.

*

INT. SATHERS' HOUSE -- NIGHT (N2)

Jess is in jammies -- boy shorts and a tank -- as Ryan peers out the front window.

RYAN: So you ended it.

JESS: I guess I was inspired after our talk last night. So I called him, told him I didn't want to see him anymore. And now here I am, down a boyfriend, up a stalker.

RYAN: There he is. Drives a Mustang, huh?

JESS: Yep. Hopefully he'll see your car in the driveway and take the hint.

RYAN: Or he'll decide to come in.

JESS: He's coming in?

RYAN: Go upstairs and lock the door.

Jess goes upstairs as Ryan opens the door. Faces Jim -- 19, fratty, a preppy version of the bully.

RYAN: Look, man, Jess doesn't want to see you.

JIM: And who the hell are you? Her bodyguard?

RYAN: No. But I will kick your ass if you come one step further.

Jim gets it -- Ryan's not joking around. He thinks about it, then takes a step back.

JIM: Tell Jess I want to talk to her.

RYAN: I'll pass it on. Now get outta here.

Ryan shuts the door. He stands there a beat, until Jess emerges.

JESS: He's gone? (off Ryan's nod) You think he's gonna come back?

RYAN: He might.

JESS: Then don't leave, Ryan, please. (she senses his reluctance) You told me I would be okay if I broke up with him. And now things are worse...

RYAN: I guess I could sleep on the couch.

Off Jess -- relieved he's staying.

INT. SATHERS' HOUSE -- LATER (N2)

Ryan is propping pillows on the couch. Lays down. Jess approaches.

JESS: As she lays down in front of him. Mind if I join you?

RYAN: You got your own bed, Jess.

JESS: I won't take up too much space.

She takes his arm, puts it over her body. They settle into their spooning position. Off Ryan, knows he's in deep.

End of Act Two

*

They're having a good time when Ryan's cell rings. He gives Sadie the "one second" gesture and the picks it up.

RYAN: Jess?

INT. SATHERS' HOUSE -- INTERCUT (N4)

Jess' friend, Kim, is on Jess' cell phone. In the background, we can see that girls' night in has evolved into a full-fledged party. Kids are drinking, hanging out, etc.

KIM: Is this Ryan Atwood?

RYAN: Who's this?

KIM: Kim, I'm Jess' friend. Look, we really need you to come over here --

RYAN: Whoa, whoa, what's that in the background?

KIM: Well, word got out about Jess' tonight, and now half of USC is here. And supposedly Jim is on his way here and on a rampage.

RYAN: So grab Jess and get out of there.

KIM: I would. But she's locked in her bedroom. She's drunk and she's crying and she says the only person she'll talk to is you.

RYAN: Look, I'm out to dinner right now.

KIM: I found your number in her phone. I wouldn't be calling if I wasn't scared something bad might happen. Ryan, she's got a bottle in there with her.

RYAN: I'll be right over. (he clicks his cell shut) Sadie --

SADIE: It's okay. I get it.

RYAN: You do?

SADIE: Well, no. But I get that something's pulling you under. And I get that you can't let it go. So whatever it is, go deal with it. Find me when you're done.

Ryan, hating being in this position, gets up and leaves her --

INT. SATHERS' HOUSE -- NIGHT (N4)

Ryan wades through the crowd until he finds five or so worried-looking sorority girls huddled outside Jess' bedroom door. Kim approaches.

KIM: Ryan, I'm Kim. I'm so glad you're here.

RYAN: I take it she's in there? (he approaches the door) Jess, it's me. You want to let me in?

There's a pause, and then the door opens. Ryan slips inside...

INT. SATHERS' HOUSE - JESS' BEDROOM -- CONTINUOUS (N4)

...to find a drunk, crying Jess. Off the rails. She immediately puts her arms around him.

JESS: You came.

RYAN: What is it, Jess? What are you so upset about?

JESS: I thought I could just have some friends over. But then I started missing you...

RYAN: Look, lets go outside. Your friends are worried about you.

JESS: I don't want to be with my friends. (then, taking his hand) I want to be with you.

RYAN: Jess, this isn't a good idea.

As she gently pushes him down on the bed. Gets on top of him...

JESS: Are you kidding? This is the first good idea I've had. Trey, Jim, none of those guys knew how to take care of me. You take care of me, Ryan.

And with that she leans in for the kiss. Ryan, with a straddles Jess on top of him, doesn't resist... and then, there's a banging on the door. Jess starts.

JIM: (O.S.) (sounding enraged) Jess? I know you're in there.

RYAN: That's Jim, isn't it.

JESS: If he finds you in here he'll kill you.

And then -- BAM, the door is kicked open, revealing an angry looking Jim, not liking the sight of his ex on the bed with Ryan. Off Ryan -- here we go.

End of Act Three

*

Act Four

INT. SATHERS' HOUSE - JESS' BEDROOM -- NIGHT (N4)

Ryan gets up off the bed and goes towards Jim, trying to calm him down, as Jess cowers by the bed.

RYAN: Hey, just take it easy, okay?

JIM: I walk in on you in bed with my girlfriend and you want me to take it easy?

JESS: I'm not your girlfriend, Jim.

JIM: You're the guy from the other night. (then, to Jess) How long you been seeing him?

RYAN: Look, there's nothing going on between us.

And he pushes Ryan up against the wall. Jess gives a little shriek.

JIM: You're just in her bed, with her on top of you? You expect me to buy that?

RYAN: Look, you want to fight me? Fine. Let's just take it outside.

He follows Jim outside...

INT. COHEN HOUSE - SETH'S ROOM -- NIGHT (N4)

Seth's sitting on his bed, depressed, when Taylor comes in.

SETH: Taylor, please. I really don't want to talk to you about my sex problems with Summer.

*

TAYLOR: Then listen and learn.

EXT. SATHERS' HOUSE - BACK YARD -- NIGHT (N4)

Ryan follows Jim outside when kids have gathered by the pool. Everyone looks on, sensing the imminent fight.

JIM: You think you can just show up at a party with my friends, hook up with my girl, and there's not gonna be consequences?

RYAN: Look, she's just a friend of my brother. I don't have anything to do with this.

JIM: Then what are you doing here?

A beat before Ryan realizes that that's a really good question. Before he can react -- BAM. Jim clocks him. Ryan goes down.

JESS: Jim, stop it.

Ryan gets up. Throws Jim down on the ground.

RYAN: Now listen to me. You gotta stay away from this girl. She's trying to start over and you gotta let her.

JIM: None of your business, man.

RYAN: I know. That's why I'm leaving.

He walks out, as kids watch him go. Jess runs after him, catches him before he gets to the house.

JESS: Ryan, are you okay?

RYAN: I'm fine. Listen, if you're smart, you'll stay way from him. And my brother.

JESS: Of course I will. After the way you fought for me?

She puts an arm on his shoulder. He lifts it up, places it back at her side.

RYAN: Jess, you gotta stop dating guys like him. And I gotta stop dating girls like you. Take care of yourself.

He walks off, leaving her standing alone, wondering what just happened. As her girlfriends encircle her...

INT. SUMMER'S HOUSE - FOYER - NIGHT (N4)

Summer opens the door to find Marissa. Marissa comes inside. Sees that Summer is blue.

MARISSA: You okay, Sum?

SUMMER: Cohen called. He said he's coming over and he wants to talk. Does not bode well.

MARISSA: Maybe he's coming because he's found a magic solution.

SUMMER: Or maybe he's coming because he's resigned to us being friends. Anyway, I'm sorry it means we can't hang out tonight.

MARISSA: I totally understand. Call me later.

INT. YACHT CLUB -- NIGHT (N4)

A waiter collects Griffin's menu, turns to Sandy.

WAITER: And you, sir?

SANDY: Actually, you mind coming back in a few minutes? Thanks.

The waiter steps away.

HENRY GRIFFIN: If you'd like me to recommend something --

SANDY: Shrimp fresca. That's what I'll order if I'm still here in ten minutes.

HENRY GRIFFIN: So we're diving right in, are we?

SANDY: I'll make it simple for you. Let us keep the hospital contract and I'll eat a meal with you.

HENRY GRIFFIN: You think it's my decision?

SANDY: I don't care whose decision it is. I'm not sandbagging Matt. He's had a few missteps, but nothing to warrant this and you know it.

HENRY GRIFFIN: And the sparing one life to save many argument?

SANDY: Doesn't apply. Look, the Board loves you, Henry. One phone call from you and nobody's sparing anyone.

HENRY GRIFFIN: What makes you think I'd do that?

SANDY: Business. Ours is the best plan and you're a good businessman. Makes me wonder about the Board, though. How they're willing to scrap a potentially lucrative project over one man's barely offensive behavior. (getting suspicious) Doesn't make a whole lot of sense from a business perspective, does it, Henry? But maybe that's the wrong perspective. Maybe this is personal. (seeing the truth in Henry's eyes) This is about Matt breaking Maya's heart, isn't it?

Henry's silence says it is.

SANDY: Does the Board even know about this?

HENRY GRIFFIN: Just a father looking after his daughter.

SANDY: Against which reason and logic doesn't stand a chance.

HENRY GRIFFIN: All different kinds of loyalty, Sandy. I chose mine. Now your choose yours.

SANDY: Hospital or Matt.

HENRY GRIFFIN: Eating shrimp or saying goodnight.

Off Sandy as the waiter reappears --

WAITER: Have you made up your mind, sir?

INT. SUMMER'S HOUSE - SUMMER'S ROOM -- NIGHT (N4)

Seth enters. Summer's on her bed with Princess Sparkles.

SETH: (re: Princess Sparkles) Hey. Am I interrupting?

SUMMER: No. Princess Sparkles is just here for emotional support. You know, helping to cushion before the fall.

SANDY: I don't need to tell you what a big deal this is. I've risked everything for this hospital --

GRIFFIN: Look -- if it weren't for me, your firm would be belly up right now. Which is why I don't appreciate you accusing me --

SANDY: I'm not accusing anybody of anything. Though I might add, you seem a touch defensive, Henry.

GRIFFIN: (sincere) The only business I'm in is the business of helping people. And I'd like to believe we're partners in that.

SANDY: You're a good man, Henry. So give me your word and I'll give you the benefit of the doubt.

Henry rises. Looks Sandy in the eye. I didn't become a doctor to get rich, Sandy. I did it because I love medicine. (beat) You have my word.

Sandy having to trust someone here, trusting him.

INT. SUMMER'S HOUSE - FAMILY ROOM -- DAY (D3)

Movers are leaving as Julie peels off a couple tens.

JULIE: Thank you so much... you've done a wonderful job...

They walk off. Leaving Julie alone. In this giant home. She beams. Claps her hands. And squeals with joy.

Suddenly she looks over as the housekeeper is standing there. Having witnessed this.

JULIE: Hola, Mima. Es bueno... Vamonos, por favor.

MIMA: I'm from the Philippines.

JULIE: Oh. Well then...

Mima gives Julie an eyeful. Julie glowers back. Mima retreats. No one beats Julie in a stare down.

INT. HARBOR SCHOOL - PARKING LOT -- DAY (D3)

As kids stream out to their cars, we pick up Summer. She slows when she sees Marissa sitting on the hood of her car, waiting for a ride.

SUMMER: Wow, Coop. You make a really good hood ornament.

MARISSA: Funny.

SUMMER: I know.

Marissa takes a swig from her flask. Chokes it back.

SUMMER: Are you getting drunk?

MARISSA: More like staying drunk...

SUMMER: Good plan.

MARISSA: Don't start with me.

SUMMER: No, I think I'm gonna --

Marissa slides off the hood. Stowing her flask.

MARISSA: I can't deal right now --

*

MATT: If you're so sure I don't have a case, you shouldn't care if I leave with this box.

SANDY: Doesn't need to go down like this.

As Matt passes Sandy, box in hand, he glowers.

MATT: Doesn't seem like I have a choice. (beat) Game on, Sandy.

Matt walks off. Off Sandy -- torn. Knows there's more to this... but doesn't want to jeopardize the hospital...

INT. DINER -- EVENING (N3)

Ryan and Sadie eat.

SADIE: So this is romantic. Original too.

RYAN: I'm a creature of habit. And when you find chili fries like this -- hard to walk away...

SADIE: Ah yes... the lure of the chili fry. A natural aphrodisiac.

RYAN: I think we'll be fine, long as Seth is nowhere near by.

SADIE: Good. Cause also I have some news -- which is good news --

Ryan is distracted by a nearby table, full of Volchok's buddies. The tattooed surfer sees Ryan --

TATTOOED SURFER: (for Ryan's benefit) Have you seen the chick Volchok's banging? Man, she is so clean...

SURF BUDDY #1: Not after she's been with Volchok.

*

RYAN: Volchok around?

TATTOOED SURFER: Why, you looking for your girlfriend?

RYAN: No, for him. And if you see him, tell him that. And to meet me under the pier. Tomorrow morning. (beat, leans in) Can you remember all that? Or you need me to write it down for ya?

The tattooed surfer eyeballs Ryan. Doesn't like his attitude.

SURF BUDDY #1: Yeah, we'll tell him.

Ryan stares down tattooed surfer. Walks out. As the diner door slams shut --

End of Act Two

*

SUMMER: Tons of. I know Marissa has several events she'd like to share with the family.

DR. ROBERTS: Summer, maybe you can make that pineapple dessert I like with the graham cracker crumbs?

MARISSA: I'm sure daddy's little girl would be happy to.

SUMMER: Excuse me.

MARISSA: I gotta go.

And the girls rise simultaneously, chairs scraping the stone, almost collide with each other as they head inside.

JULIE: (forced smile) Sisters...

INT. JOHNNY'S HOUSE -- MORNING (D4)

Ryan knocks and enters, expects to find Sadie. Finds instead -- a man (late 20s, good looking), taking measurements.

RYAN: Hey. Uh, I'm looking for Sadie --

BOB: Hey. She's in the shower. (as she enters, hair wet) Or, was.

SADIE: Ryan. You meet Bob?

RYAN: (the hell is this guy?) Hey. Bob.

SADIE: (to Bob, gives him a key) Garage door sticks a little. Make yourself at home, okay?

Bob exits, Sadie heads into the kitchen. Ryan follows.

*

KIRSTEN: You'll see.

SETH: Crappy rec center basement, bad coffee. I don't think you're in Weight Watchers, so either you're the lead in a community theater group, or you've converted to a very underfunded religion.

A hippy-ish woman (40s) stands and calls to the group --

HIPPY-ISH LEADER: Welcome to the Newport Chapter of Alcoholics Anonymous. Hello --

The audience responds with a "hello." Seth looks at Kirsten, suddenly feeling tricked. He gets up, she follows.

KIRSTEN: Seth -- I was afraid if you knew, you wouldn't want to come.

SETH: (stops, turns) Good instinct. (off her look) Like dealing with this the first time wasn't painful enough?

KIRSTEN: (passionate) This place has saved my marriage, my family, quite possibly my life. These people know more about me than my own family --

SETH: (getting heated) Who's fault is that? It's not like you ever talk about what happened --

KIRSTEN: It's not like you ever ask. And if this is how you act when I try to share it with you --

SETH: There's sharing and there's... lying.

*

Matt's expression changes, he pushes delete. Just then, the doorbell rings. Matt crosses --

INT./EXT. MATT'S APARTMENT - FRONT DOOR -- MOMENTS LATER (N4)

Matt opens the door and WHAM! A big guy bashes his forearm into Matt's throat, sends him staggering back --

MATT: What --?

Two other guys rush in and take him down.

BIG GUY: Hold onto 'im. Lemme get these...

He's found Matt's files, starts grabbing them.

MATT: No... you're not seriously gonna --

But a boot finds his kidney, nails him. Then again. Matt reacts, white with pain. File box full, the big guy exits.

BIG GUY: Let's get outta here --

Matt makes an attempt to grab him as he passes but he gets a boot in the face, head snapping back. Out cold.

INT./EXT. JOHNNY'S HOUSE - FRONT DOOR -- NIGHT (N4)

Ryan knocks on the door. Flowers in hand. Dressed nice. It's sweet. The door is opened by -- Bob, measuring stuff.

RYAN: Hey, Sadie around.

BOB: No, actually --

RYAN: Mind if I come in and wait?

BOB: Might be a while. (off Ryan) You just missed her. She left for Oregon a couple hours ago. Sorry --

And Bob shuts the door. Off Ryan -- reeling.

End of Act Three

*

He's clearly hurting, Marissa wants to hug him, stops herself.

MARISSA: Okay. Well... (gestures to the lifeguard tower) Enjoy.

RYAN: I'll leave it as I found it...

Marissa heads off. Ryan is head down, thinking. As Marissa slows and turns, watching him.

INT. REC CENTER -- NIGHT (N4)

The AA meeting is in full swing. A wizened old guy has the floor, giving a testimonial.

WIZENED OLD GUY: ...I'd pissed in the streets, eaten out of garbage and accidently shot my wife not once but twice --

SETH: (aside to Kirsten) Now that's a heartwarming tale.

KIRSTEN: Hey... he's been sober thirty years.

HIPPY-ISH LEADER: Thank you for that, George. Now before we leave, we have a pin to give out today. Kirsten, if you'd like to join me.

Kirsten smiles, rises. Seth looks at her -- what? There's clapping in the group, hoots, "Yeah Kirsten!" etc.

HIPPY-ISH LEADER: (handing her the pin) Kirsten, congratulations, you're eight months sober.

And Seth realizes -- this is why she brought him here.

Spoilers for episode 3.21 - The Dawn Patrol...

*

SANDY: Hiya doing. Reservation under Cohen. Meeting the Urban Planning Committee. (beat) Yes, it's as fun as it sounds.

MAITRE D': Of course, Mr. Cohen. One of your guests has arrived early --

SANDY: Really?

As the Maitre D' points to the bar. Where Sandy sees Matt.

SANDY: Don't save him a seat...

Sandy crosses over to Matt, who quickly downs his cocktail.

MATT: (to the bartender) Another Starr and Ginger?

SANDY: Get it in a to-go cup.

MATT: What's the matter, Sandman? Not happy to see me?

Matt slides a piece of paper across the bar. Sandy lifts it.

SANDY: What is this?

MATT: A projection of what my future earnings with the Newport Group would've been. Plus pain and suffering. Which have been considerable.

SANDY: You want me to pay you?

MATT: Actually Griffin. He's the one I've got evidence on. Otherwise the D.A. would be very interested in the documents I've got.

*

VOLCHOK: And what about school?

MARISSA: Second semester, senior year. (beat) Unless you don't want to --

Volchok realizes he's overreacted. Revealed vulnerability. He shrugs, raises up his joint. As he sparks it...

VOLCHOK: Wanna blast off?

Marissa shrugs, okay. As she vanishes in a cloud of smoke...

INT. ALBUQUERQUE DINER -- DAY (D2)

Basic mid-century diner. Sparse post-lunch crowd on hand, when Ryan walks in. Chloe (20), a cute, young waitress, glances up from her romance novel.

CHLOE: Wherever you want. Place is all yours.

RYAN: Actually, I'm looking for someone. Dawn Atwood.

Chloe considers this, considers Ryan.

CHLOE: Her shift doesn't start for a couple hours. Who should I say is looking for her...?

RYAN: (considers) A friend. (beat) I'm staying at La Mirada I think --

CHLOE: Nice hotel. Dawn doesn't have any friends who stay at nice hotels.

RYAN: I got a good rate.

CHLOE: She does however have a son. Lives with some pretty wealthy people as Dawn describes it. (beat) Also supposed to be cute.

RYAN: (smiles, busted) Ryan.

CHLOE: Chloe. (they shake) Your mom is going to lose it when she finds out you're here.

RYAN: I hope not... (checks his watch) Couple hours, huh? I'll be back.

CHLOE: I'll be here.

Off their flirtatious smiles... Ryan exits. Chloe watches him.

INT. HARBOR SCHOOL - CLASSROOM -- DAY (D2)

Seth and Summer sit in class. Mr. Greenburg drones on... As he does, Summer tries to get Seth's attention. Waves. Winks. Seth pretends to be interested by:

MR. GREENBURG: Let's discuss factoring a polynomial. This is good stuff... It's an expression in which constants and variables are combined using only addition, subtraction and multiplication...

He turns to the board; writing 2x2yz3-3y2+5yz-2... Summer waves at Seth furiously -- other students looking on. As Mr. Greenburg turns back around, Summer stops. Looking casual.

MR. GREENBURG: Thus this equation is a polynomial.

As Greenburg turns back to the board to write more --

*

JULIE: Don't get smart with me. You don't have the equipment. Her school called. She didn't show up today.

VOLCHOK: She already got into college.

JULIE: Listen up, Tommy Lee. You're just the latest in a series of experiments my daughter likes to make when acting out. So enjoy it. Because right here, right now is as good as it gets for you. Soon Marissa is going to wake up and realize how much better she is then you and this life.

On Marissa -- hiding...but moved.

VOLCHOK: You think then she's gonna come running back to mommy?

JULIE: Marissa knows that I will be there for her whenever she decides to come home. Because I am her family. Not some punk with a smirk, three brain cells and a good coke connection. Tell her that.

Julie exits. Volchok is a little thrown by this. As the door closes, and Marissa comes out of hiding. They share a look, but Volchok is shaken. Marissa forces a smile.

MARISSA: So... that's my mom.

VOLCHOK: I'm gonna get us some beers.

He exits. Off Marissa -- this is complicated.

INT. TEX MEX BAR -- NIGHT (N2)

A down, Southwestern style bar. Ryan and Chloe stand by the bar. He sips a beer, as does she...

RYAN: You won't tell my mom I bought a beer, right?

CHLOE: Also not gonna tell these guys you're under twenty-one...

They clink bottles. Ryan's still tense...

CHLOE: You traveled pretty far to avoid her.

RYAN: Just... working up to it. Don't know how much you know, but we haven't had the easiest relationship.

CHLOE: Knowing Dawn a little -- I figured. But if it makes you feel better -- she's doing well.

RYAN: Yeah, I saw that. She seemed happy. There was some dude in a trucker hat and tattoos that kinda made me nervous but --

CHLOE: Oh that's just Ron. Her new boyfriend.

RYAN: That's what I was afraid of.

CHLOE: He looks hardcore. And yes, he owns a rather large snake. But he's got a good heart.

RYAN: They always do at first...

CHLOE: (smiles, hand on him) Aw. Look at those sad, puppy dog eyes. You've done a lot of living and you're not yet twenty-one.

RYAN: Don't tell anyone...

She smiles and surprises both of them with a kiss. Weirdly, it's just what Ryan's looking for right now.

CHLOE: I love this song... you wanna?

RYAN: I don't really -- not so good at --

Chloe takes his hand. They step in front of the jukebox. They slow dance, beers in hand. And slowly their lips find each other again --

RYAN: This is not what I expected...

CHLOE: Yeah, well, maybe it's what you need.

Off the two of them -- holding onto each other...

INT. NEWPORT GROUP - SANDY'S OFFICE -- NIGHT (N2)

After hours. Sandy scrutinizes the construction model for the hospital. Head heavy with thought. Sandy sees Dr. Griffin darkening his doorway.

DR. GRIFFIN: You got a way with people. Urban Planning Committee is signed off.

SANDY: What can I say... I'm a real charmer. Close the door.

DR. GRIFFIN: Your message was rather cryptic. We have a problem?

SANDY: Not me. So far I've managed not to beat, blackmail or extort anyone.

DR. GRIFFIN: Can't we let this Ramsey issue go --

SANDY: Unfortunately he can't. Matt never left town. But since you had nothing to do with the ass-kicking he took, the news shouldn't get your blood up.

DR. GRIFFIN: What did he want?

*

BARTENDER: Can I get you a drink, ma'am?

Before Kirsten can answer, Dr. Woodruff sits next to her.

DR. WOODRUFF: Two diet sodas, please.

KIRSTEN: Dr. Woodruff. It's so good to see you.

DR. WOODRUFF: Out of rehab, call me Ken. (smiles) So, what's going on Kirsten?

KIRSTEN: Well... First thanks for seeing me on such short notice. (beat) The truth is... I didn't know who else to call... to talk...

DR. WOODRUFF: Your husband?

KIRSTEN: We haven't been seeing eye to eye lately... When we see each other at all. And recently I've found myself... tempted.

DR. WOODRUFF: Naturally. If you're facing a challenge at home, it's normal to feel vulnerable. (beat) You need to reconnect with Sandy. Talk to him about what you're feeling. I can mediate --

KIRSTEN: No... that's not necessary... I can do this.

DR. WOODRUFF: I've got no doubt...

Off Kirsten -- wishes she could say the same.

*

SETH: I'm sorry, Summer. I really am. But it's for the best.

SUMMER: What? But the whole reason I un-broke up with you was to find out why you wanted to break up with me in the first place.

SETH: Well... I guess now you'll never know. See ya.

Seth walks out. Leaving Summer. Devastated.

INT. ALBUQUERQUE DINER -- NIGHT (N2)

Ryan sits at the counter as Dawn brings out pie for him.

DAWN: You look so good, sweetie.

RYAN: So do you, Ma.

DAWN: When Chloe told me you were back in town, I almost didn't believe it --

RYAN: She told you I was here?

DAWN: And my answer is yes, Ry. A hundred percent. I wouldn't miss your graduation for anything.

RYAN: (thrown, shit) Oh, yeah? (beat) She told you about graduation too, huh?

DAWN: Just called me.

Nick, the greasy cook, dings his bell.

NICK: Let's go, Dawn. Food's getting cold.

DAWN: I hear you, Nick. This is my baby.

NICK: And this is my meatloaf. Get it out there.

Dawn looks at Ryan -- who gets it --

RYAN: I'm gonna go back to the hotel. I'll see you tomorrow.

DAWN: You bet. So good to see you. (beat) And thanks for asking me. Well, I guess, Chloe asked me but you know...

RYAN: Yeah... (beat) Good to see you too...

And as Dawn hustles some orders out, Ryan watches her a beat...

EXT. COHEN HOUSE - BACK YARD -- NIGHT (N2)

Seth lands in a lounge chair. Feels terrible. Stares out at the ocean.

EXT. ALBUQUERQUE DINER -- NIGHT (N2)

Ryan exits the diner. Leans against the wall. Exhales. Things getting more complicated...

END OF ACT TWO

*

CHLOE: Then you should treat yourself.

Nick the cook pops his head in --

NICK: Chloe, you got a customer. Dawn, your boy's here.

They exit to --

INT. ALBUQUERQUE DINER -- CONTINUOUS (D3)

Dawn and Chloe find Ryan at the counter. He stands, crosses to her.

DAWN: Morning, hon. Chloe here was talking me into a new dress for the big day --

CHLOE: I'll get some coffee.

RYAN: You don't have to buy something, Ma.

DAWN: I want everything to be perfect. (off Ryan) And I was thinking -- after the ceremony, I'd like to take everyone out to dinner. Nothing fancy, if I'm footing the bill, but --

Dawn's cell phone rings. She answers, excited.

DAWN: Hey baby, stayin' outta trouble in Little Rock?... Vegas? You are so bad... I'm sorry you had to go on the road last night. I really want you to meet Ryan. But I checked on flights to Orange County. One sec, Ron -- (to Ryan) It's okay if I bring a friend, right? (what can he say?) Let me get my calendar...

Dawn heads to the lockers. Chloe arrives with Ryan's coffee.

*

ACT FOUR

INT. LA MIRADA HOTEL -- NIGHT (N3)

Ryan finishes packing as Chloe stands by.

RYAN: Look -- you don't know her the way I do.

CHLOE: Never said I did.

RYAN: It's been the same thing my whole life. She gets clean for a while, promises she's changed. Then she meets some lowlife, moves him in, and bottoms out.

CHLOE: How many of these lowlifes did she meet in rehab?

RYAN: What, that guy Ron?

CHLOE: Hasn't had a drink in twelve years. Pays for their apartment, fixed up one of his old cars for her.

RYAN: I didn't know...

CHLOE: Didn't want to. (off Ryan) Maybe you'd already made up your mind about him. About your mom, too.

A beat as this lands. Might be right...

RYAN: (zips up his bag) I gotta go. Car's waiting to take me to the airport.

CHLOE: I'll drive you. After all the trouble I caused, it's the least I can do. And... there's a stop I want us to make on the way.

Off Ryan -- unsure he's up for the trip...

EXT. VOLCHOK'S APARTMENT - ALLEY -- NIGHT (N3)

Volchok exits his building, wound up. Finds Marissa on her cell, frustrated, a groggy Heather in tow.

VOLCHOK: What's going on?

MARISSA: (into her phone) Hi, I called for a cab like twenty minutes ago... Cooper... Thanks.

She ends the call. He tries to soothe her.

VOLCHOK: Hey, you don't need to split. Just bring her inside. She always gets like this.

MARISSA: That guy tell you what happened...?

VOLCHOK: He said she was into it.

MARISSA: How can she be into him when she can't even see him...?

Volchok goes to Heather. She's in rough shape.

VOLCHOK: Hey, Heather... you okay?

HEATHER: (barely conscious) Hey baby...

VOLCHOK: See, she's fine. You don't have to make a big deal. Nothing happened.

*

DR. ROBERTS: You throw all these parties for the dating service.

JULIE: I have Kirsten with me then. She's a buffer. A wingwoman.

DR. ROBERTS: Then invite her and Sandy. He can network with the doctors, she can... wingwoman. (then) It would mean a lot to me.

Julie glances at the rock on her finger. Dr. Roberts isn't her husband quite yet...

JULIE: Then I'm there.

EXT. BERKELEY - QUAD -- MORNING (D1)

A banner reads "Welcome to Berkeley!" Dozens of kids congregate around tables with maps, name tags, etc. Ryan looks around the campus. In awe. A student, Wes (preppy, good-looking, a young Jimmy Cooper), approaches.

WES: Ryan Atwood, sorry I'm late. I'm Wes Seifer. Your freshman buddy.

RYAN: Nice to meet you.

Wes takes Ryan's bag for him.

WES: Come on, I live off-campus, but we can walk it. You mind an inflatable mattress?

RYAN: Not at all. I'm just happy to be here.

They walk through the quad.

WES: Saw in your profile you're from Newport. You go to Harbor?

RYAN: (nodding) You know it?

WES: Few guys in my hall went there. You play water polo?

And Ryan realizes Wes probably has him pegged for someone else. He has the sudden urge to be candid.

RYAN: I'm not really from Newport. I mean, I am. But until two years ago, I lived in Chino. (then) Figured I might as well get that out of the way.

WES: (smiling) I think you'll be okay.

RYAN: What do you mean?

WES: Got one roommate from Bangladesh. Other's from Partridge, Kansas. Population 300. There's no mold here... which means it's pretty easy to fit in.

RYAN: Guess I'm not used to that.

Off Ryan -- for once feeling like he doesn't have to be anything but himself.

INT. DINER -- MORNING (D1)

Marissa walks in, sees Volchok sitting in a booth.

VOLCHOK: Surprised you showed.

MARISSA: Look, Summer's waiting for me and I've got a plane to catch, so if you could just give me my things?

VOLCHOK: Don't have 'em.

MARISSA: What? Why not?

*

INT. BERKELEY - STUDENT UNION -- LATE AFTERNOON (D1)

Ryan and Wes eat at a table. Wes' friend, Miguel, is with them.

MIGUEL: (good-natured) So your dad's in jail? I got a dad, one brother, and two uncles locked up. Beat that.

RYAN: (smiling) Think I'm out of my league.

WES: Miguel's the first in his family to go to college too.

RYAN: Is it hard? I mean, do you ever feel like you shouldn't be here?

MIGUEL: All the time. But hell, here I am. Long as I keep my grades up, I figure I belong here as much as anyone else.

As Ryan takes this in, liking the simple logic of this...

WES: Wow. I mean. Wow.

Ryan turns and follows Wes' gaze to Marissa, who is standing with a tray, looking a bit lost. Marissa looks over and sees Ryan. After a moment of hesitation, she does the mature thing. Starts to approach...

WES: And she's headed this way...

MARISSA: (to Ryan) Hi.

RYAN: Hey.

WES: You two know each other?

MARISSA: Yeah. Ryan and I are... (how else to put it?) ...in the same class.

*

SETH: I'll just riff. You know, we're both dudes. Even though he's got a bow tie and probably like nine PhDs, I bet inside we're a lot alike.

ANNA: You could at least come up with some talking points --

SETH: Look, he's alone. This is my moment.

ANNA: (dreading this) Good luck.

As Seth goes to approach Dr. Overbee, we see Summer in the crowd, chatting with a few other pre-frosh kids.

PRE-FROSH #1: The fact is, the U.S. has been performing it's own jihads for decades. Just instead of Allah, the killing is done in the name of oil.

PRE-FROSH #2: Totally.

SUMMER: You guys? What's a jihad?

A moment of silence. Then the kids nod, impressed.

PRE-FROSH #1: Exactly.

PRE-FROSH #2: Way to reframe the question, Summer.

Summer smiles, happy with herself, when suddenly she sees Seth across the room, talking ot Dr. Overbee. She does a double-take. Did she just see what she thought she saw?

Angle on: Seth talking to Dr. Overbee.

SETH: You may remember me from my application essay. It was about Superman? Lonely guy, Superman.

DR. OVERBEE: (pleasantly) I don't recall it at the moment. But if you're here today, I trust it was exceptional.

SETH: (a small grimace) Yeah. About that. If you have a moment, maybe take a walk? You feel like stretching your legs?

DR. OVERBEE: I'm sorry. This is a faculty reception. I have to be here. (attempting a getaway) Well, I should probably make the rounds. Nice to have met you.

He starts to move off. Seth stops him.

SETH: Dr. Overbee, I really need to talk to you. If you can't do it now, then name the time and place. All I need is five minutes.

DR. OVERBEE: (reluctantly) I suppose I can meet you here tomorrow. Around five.

Dr. Overbee walks off. Seth calls after him.

SETH: Thank you. Thank you so much.

SUMMER: (O.S.) Cohen?

Seth turns to see Summer. Who is standing right next to him. Aghast, surprised and angry.

SETH: (feigning casual) Oh hey. How's it going?

SUMMER: What the hell are you doing here?

SETH: Heh. Providence in spring. Can't beat it.

SUMMER: So you are going to Brown. You just didn't want to go with me.

Anna appears, coming out of the crowd. She doesn't see that Seth's talking to Summer.

ANNA: (to Seth) How'd it go?

SUMMER: Anna?

Anna turns. Sees Summer. Both astonished.

ANNA: Summer?

Seth knows he's in deep shit. Turns to Summer.

SETH: Okay, you're probably really confused right now --

SUMMER: Actually, I'm not. All of this -- everything you've done... it finally makes sense.

Devastated, she turns and disappears into the crowd. Off Seth -- things just went from bad to worse.

INT. BERKELEY - WES' HOUSE -- NIGHT (N1)

Low-key party underway. Marissa and Wes are hanging out.

WES: So you and Ryan dated for how long?

MARISSA: Couple years. But we've both been with different people since then. It's not exactly normal yet, but we're getting there. (then) Where is he, anyway?

WES: Tour of the architecture building. Never set foot in there, so I couldn't really show him around.

MARISSA: Where do you do most of your hanging out?

WES: Business building. Sexy, I know. (off her laugh) Most people at this school want to change the world, I want to change the NASDAQ.

MARISSA: My dad was a business major. Actually, you kind of remind me of him. The good parts, at least.

WES: If that's a compliment, I'll take it.

MARISSA: It is.

A flicker of a moment between them. Just then, Ryan enters. Marissa suddenly feels odd.

MARISSA: One second. (she approaches Ryan) Ryan, hi.

RYAN: I didn't know you were gonna be here.

MARISSA: I hope it's not weird that I am. I guess I don't really know what the rules are between us...

RYAN: Me either.

MARISSA: Look, I know we didn't have much luck with the friendship thing in Newport...

*

ANNA: Now remember, you're just going to tell her the truth.

SETH: Right. All of it.

Seth approaches Summer.

SETH: Summer, can I talk to you?

SUMMER: Leave me alone, Cohen.

Jack (gung ho, the type to work in admissions), the student leader of the walking tour, claps his hands to get everyone's attention. He stands by a table with name tags on it.

JACK: Hey everyone, I'm Jack. I'm a sophomore here at Brown, and I'm gonna be leading your walking tour. So as long as everybody's got their name tags, we'll get started.

SETH: I want to explain. And I mean about everything.

JACK: (to Seth) You there. In the striped shirt. Got a name tag?

Seth looks at the table, where there are a few name tags of no-shows. He grabs one and slaps it on his shirt. Meanwhile, Summer moves away from him into the crowd.

SETH: Yep. All set.

JACK: Okay, then... (squinting at Seth's tag) ...Kumar. You're Kumar?

SETH: Yeah. Kumar... Zimmerman. Half Indian, half Jew. I'm a Hin-Jew.

JACK: Good then. To our left we've got the dining hall. The Sharpe Refectory, affectionately known as "The Ratty"...

As Jack continues, the crowd starts to move en masse, as Seth weaves through people, working his way back to Summer.

SETH: Look, ever since our acceptance letters came in, I've been acting like a freak. I know that.

Summer ignores him. Raises her hand.

SUMMER: (to Jack) Does this tour come with an audio option? You know, like those headsets you get when you go to the museums?

JACK: Uh, no. Anyway, here we've got the Main Building, the oldest one on campus.

As Jack continues...

SETH: Summer, you can't just ignore me forever.

SUMMER: Oh yes I can. Do you remember middle school? I was good at ignoring you. And I'm gonna get back into shape.

SETH: Look, I had no idea Anna was gonna be here --

JACK: Hey Kumar? Kumar. (Seth looks up) You want to keep it down?

SETH: Sorry.

*

RYAN: No, I'm glad you did. It's funny -- in a way I was expecting it. For once things were kinda... uncomplicated. How long could that last, right?

KIRSTEN: There's a good chance that baby I saw wasn't even hers. Much less yours.

RYAN: (not very optimistic) Yeah. I know.

KIRSTEN: Listen, whatever's going on with Theresa, we're gonna get to the bottom of it. (hands him a piece of paper) Here. I did a little online detective work. Turns out Theresa lives here in Newport. She's got a place in the Vista Towers. Phone number.

Ryan takes the paper. This is some heavy shit.

RYAN: Thanks. (re: his luggage) Just gonna take this into the pool house.

KIRSTEN: And Ryan? No matter what happens, we're behind you.

He gives her a small smile. And leaves. Off Kirsten -- hopes she did the right thing.

INT. BROWN - STUDENT UNION -- LATE AFTERNOON (D2)

Seth is sitting, looking anxious. Dr. Overbee enters.

SETH: Dr. Overbee. You made it.

DR. OVERBEE: Yes, well, as I said, I only have five minutes.

SETH: Of course. You're a busy guy, and I have a tendency to ramble, which is why I've prepared this statement. (he pulls out speech) Dr. Overbee, the following is a list of reasons why I should have gotten into Brown.

DR. OVERBEE: I don't understand -- you didn't get in?

SETH: No. But I'm sure that's only because there was some kind of clerical error, or human error or maybe a computer froze --

DR. OVERBEE: (annoyed) Mr. Cohen, I thought you were an admitted student. That's why I came to meet you.

SETH: Just listen, and if you still don't want to let me in, then at least I'll know I tried.

Dr. Overbee sighs. Can see how desperate Seth looks. Sits back down.

DR. OVERBEE: You have one minute.

SETH: One minute? Okay. Then I'm gonna have to condense this speech. Make it more of a bullet point thing. (scanning the speech) Grades -- 3.8. SATs -- 2250. Not perfect, but respectable. I was president of the comic book club. And I was on the chess team even though I was extremely low prof about it --

DR. OVERBEE: Thirty seconds.

SETH: (desperately scanning) Okay. This is how I belong on the East Coast and here's a little joke about the weather here, just to keep things light. That's mostly it.

DR. OVERBEE: Well, that was compelling. But you misled me, and you wasted my time. Now I trust you'll show yourself off campus.

Dr. Overbee stands up and is about to turn away.

SETH: Dr. Overbee, wait. I have to get in here. And not only because I love it, and I do, I really do. It's because of a girl. Summer Roberts. She's going here and if you don't let me in, I'll lose her, and the rest of my life will be ruined.

DR. OVERBEE: (smiles sympathetically) So this is about a girl.

SETH: The girl. (hopes rising) So you get it...?

DR. OVERBEE: I do. (gently) But we make commitments when we send out those letters. And for better or for worse, we stick to them.

SETH: Dr. Overbee, please.

DR. OVERBEE: I wish I could help you. But you're going to have to do this yourself. Good luck.

He smiles at Seth sympathetically and walks away. Off Seth -- the reality of his rejection sinking in...

WES: I am. Which is why I'm trying to numb myself with alcohol. Man, is that thing boring.

MARISSA: That bad, huh?

WES: Hang out here a while. We'll hit the last hour.

Wes puts an arm on Marissa's back, as he guides her through the party.

INT. THERESA'S APARTMENT BUILDING - HALLWAY -- DAY (D2)

Ryan knocks on an apartment door. The nanny answers the door.

RYAN: Hi, I'm looking for Theresa. Is she home?

NANNY: I'm sorry. Ms. Diaz won't be home until later. Can I help you?

RYAN: I'm Ryan Atwood. Old friend of hers.

A little boy wanders up to the door. The nanny scoops him up into her arms, watching as the boy stares at Ryan. Concentrates on him.

NANNY: Looks like he likes you.

RYAN: So this... this is Theresa's baby?

NANNY: (nodding) She's a terrific mom. I'll be sure to tell Theresa you stopped by.

She smiles and shuts the door. Off Ryan -- reeling.

WES: Hey, you ready to go?

MARISSA: Sure. (to the girl) Nice to meet you.

She gets up, follows Wes --

WES: We're having a little pre-party over here if you want to join.

He gestures towards a cluster of kids, who are sitting in a circle. Marissa follows Wes over to them, already not liking the feeling of this.

WES: Hey guys, this is Marissa. You wanna roll out the welcome wagon?

BERKELEY GUY #1: Course. We're not stingy.

He offers her a mirror, a line of coke spread across it. Marissa shakes her head.

MARISSA: No thanks.

WES: You okay?

MARISSA: Yeah, I just thought... I didn't think you guys did that here.

WES: Why, because I got a 4.0 last semester? How do you think I manage that? Work hard, play hard. (then, looking around) Welcome to college.

Everyone laughs, "that's right," etc.

MARISSA: I think I'm gonna take off.

WES: Come on, Marissa. Don't be like that.

MARISSA: Thanks for everything. But I gotta go...

Marissa looks around -- hates to end things this way, but she knows she has to get out of there. As she hurries out...

SETH: Well, not to worry. I'm on the next flight. Just waiting on my cab.

RYAN: Seth, don't come home early on my account.

SETH: Trust me, there are a lot of reasons. See ya when I get home.

He hangs up. A cab pulls up. Seth goes to get in. Surprised to see Anna inside. She smiles.

ANNA: Get in.

SETH: (smiles, gets in) You're giving me a ride to the airport?

ANNA: Eventually.

SETH: My flight leaves in an hour.

INT. PROM - BEVERAGE TABLE -- EVENING (N3)

The drinks table is filled with appropriately pirate-looking beverages. Marissa's happy, and trying to bond with Volchok, who's retreating into himself.

MARISSA: Have I thanked you yet for coming?

VOLCHOK: About forty times.

MARISSA: What's wrong with you?

VOLCHOK: Nothing. (changing subjects) You know your little friend took off with my flask.

MARISSA: I'm sure she'll bring it back.

VOLCHOK: I'm gonna go outside and smoke a blunt, you wanna come?

MARISSA: Thanks. I actually kind of want to enjoy prom. Find me when you get back.

She walks off, hurt. Volchok considers going after her, then doesn't. He turns. There's a chest of gold doubloons behind the drinks table. He spots Taylor's purse tucked behind it.

HOT GIRL: (O.S.) Hey.

A hot girl leans on the table next to him. She's flirty.

HOT GIRL: Did I hear something about smoking certain substances? 'Cause I know some place private.

Volchok glances around. Marissa's gone. He smiles.

VOLCHOK: Lead the way.

They head out.

SUMMER: (on microphone) He's the number one pop star in Korea.

Two Korean girls in the audience scream.

KOREAN GIRLS: (in Korean) We love you, Big Korea!

Big Korea blows them a kiss. The girls collapse in squeals.

SUMMER: (on microphone) And he promised me a kiss if I won.

Angle on Seth and Anna.

SETH: But that's not part of the plan.

ANNA: She's just fighting it. This is... good. But maybe you shouldn't watch.

Angle on Summer and Big Korea as she pulls him into a kiss. But in the process, she loses her balance and falls off the stage.

TAYLOR: Oh my God! Man overboard!

Angle on Seth and Anna.

SETH: (turning back) What happened?!

Anna rushes towards the commotion. Seth follows.

Angle on Marissa.

MARISSA: Oh my God.

She rushes towards Summer.

Angle on Summer as she's helped up by Seung Ho and Big Korea, who've jumped off the stage. She landed on a mannequin of a pirate, who had a parrot on his shoulder.

MARISSA: Seung Ho and his cousin got Summer in the limo. Have you found Kevin?

RYAN: No, but let's look inside.

MARISSA: Are you sure? He might've come out to smoke --

RYAN: I already checked. Just --

He's blocking her. Marissa senses something's up.

MARISSA: Ryan, what're you doing? Is Kevin out here?

MARISSA: Oh my God.

She goes outside. Ryan follows.

Marissa comes out. Ryan behind her. She stops, staring, horrified. Volchok hears her. He pushes the hot girl off.

She walks past a frozen Marissa. Volchok looks at her.

VOLCHOK: You gonna say something or just stand there?

Marissa walks up and slaps him. Volchok takes it.

VOLCHOK: That it? Can I go now?

Marissa, on the edge of tears, goes to slap him again, but Volchok catches her hand.

RYAN: Let go of her.

Volchok looks at Ryan, lets go of Marissa's hand.

MARISSA: Why?

VOLCHOK: Figure it out.

He turns and starts off. Marissa grabs him, turns him around, angry now.

MARISSA: Answer me.

VOLCHOK: Hey, I didn't want to come here to begin with. This isn't my world.

MARISSA: So why did you?!

VOLCHOK: Cause he made me feel sorry for you, alright?! My mistake.

MARISSA: Don't try to blame this on Ryan.

RYAN: (a little dazed himself) I, uh, I... got here soon as I could.

ORDERLY: Do you know them? (off Ryan -- know who?) The guys who did this. You know who they are?

RYAN: (about to confess) Uh, actually --

VOLCHOK: (barely audible) Got jumped. Didn't see 'em.

Ryan looks at him. Relieved he's awake. Shocked that he's... covering for him? Volchok eyeballs him. Go with it.

VOLCHOK: I'm okay...

Volchok tries to sit, but doubles over. The orderly helps him back down.

ORDERLY: C'mon buddy. Glad you're alive, but we still gotta check you out. Police'll have some questions, too.

Ryan looks over to the cops standing by the door, then back to Volchok, clearly in pain.

VOLCHOK: Yeah, okay...

As the orderly busies himself strapping the blanket around Volchok's legs, Ryan leans in --

RYAN: What're you doing, man?

VOLCHOK: Meet me at my place tomorrow. (loaded) This ain't over.

RYAN: But --

INT. KNIGHTLEY SCHOOL - DINING HALL -- NIGHT (N2)

KAITLIN: ...his name is Trevor Knightley. He's the captain of the lacrosse team --

HADLEY: (re: the hot girls) Those are his bitches. Lacrosstitutes. So heinous.

KAITLIN: He's the great-great-great grandson of the founder and basically owns this school. He's also a skeezed-out Adderall head.

MARISSA: (to Kaitlin) And what does he have against you, or should I even ask?

KAITLIN: He tried to get on me at a lipstick party and I shot him down.

MARISSA: Lipstick parties and Adderall. I'm sensing a generation gap...

KAITLIN: So the next morning he's all telling the headmistress how he saw me take the crest that hangs over her office.

MARISSA: Sounds like it's his word against yours.

HADLEY: Obvie. But he totally conceals his evilness from the faculty. Gets straight As, varsity athlete. And Kaitlin is, well --

KAITLIN: Not exactly a perfect student.

MARISSA: (smiles) You don't say.

KAITLIN: Marissa, this will be my third strike and I don't wanna get kicked out. It might not be as bad as say, shooting someone, but Mom will definitely freak. And I don't wanna be in lock-down all summer.

HADLEY: Obvie. I get so horny in the summertime.

KAITLIN: Whatever, bitch. You're horny all the time.

HADLEY: (smiles) Shuddup, bitch.

KAITLIN: You shuddup.

MARISSA: Okay, both you bitches shut up. This crest thing? What's the deal?

KAITLIN: I'm pretty sure it's in his room. But no way is he or his army of devoted, probably-gay-and-secretly-in-love-with-him homeboys gonna let me anywhere near it.

Marissa eyeballs him across the hall. Knows the type (entitled, horny) instantly.

MARISSA: I'm not usually one who comes up with the wacky scheme, but... (re: a passing uniform) You got one of those skirts?

INT. COHEN HOUSE - HALLWAY -- NIGHT (N2)

GUY: I stash my stuff in there at night. I'll leave the window open when I take off, the rest is on you guys. You got my money?

Volchok hands over some cash -- the guy, a slip of paper.

GUY: Here's the address. Good luck.

The guy nods, exits. Ryan takes the address, reads it --

RYAN: This is in my neighborhood.

VOLCHOK: (smiles) That's why you're driving.

Off Ryan -- it just keeps getting worse.

MARISSA: (British accent) Hi. Are you Trevor?

TREVOR: (interested) Yeah.

MARISSA: I'm Marissa. The new foreign exchange student? Just got here from London.

TREVOR: (staring at her boobs) I love London.

MARISSA: Everyone says if you want to learn about this school, you're the best teacher. I was hoping you could give me a tour. (off his look) Starting with your dorm room.

TREVOR: I'd love to. But I did my junior year abroad at Oxford, and I don't buy that phony English accent for a second.

She thinks on her feet, drops the accent --

MARISSA: Okay, fine. I'm not from London. I'm a stripper. Your friends bought me for your birthday.

TREVOR: My birthday's not for six months.

MARISSA: Do you wanna see me take off my clothes, or not?

*

HODES: You're in bed with him on this hospital. Until I have proof otherwise, his improprieties are yours too.

SANDY: Whatever happened to innocent until proven guilty?

HODES: But are you really so innocent, Sandy?

SANDY: (as this lands) What if you had receipts, e-mails, an eye-witness --

HODES: That would help a lot.

SANDY: And in exchange for my cooperation, you could let the Newport Group finish the hospital?

HODES: If Griffin goes down, so does the hospital, no way around that.

SANDY: So I can keep my mouth shut, and hope you lose...

HODES: Or you can help bury that crook and say goodbye to the hospital.

INT. KNIGHTLEY SCHOOL - UTILITY ROOM -- DAY (D3)

Marissa leads Trevor into a janitor's utility room.

TREVOR: You sure you wouldn't rather do this in my room...?

MARISSA: You don't want anyone walking in on us, do you? Now take off your pants.

TREVOR: I thought you were gonna strip for me?

MARISSA: C'mon, haven't you ever been to Vegas? (pulls up a chair for him) In your boxers, or I'll have to give the guys their money back.

TREVOR: (psyched, drops his pants) Screw those guys...

As he sits in his boxers, she takes the ribbon from her hair and binds his wrists to the chair.

TREVOR: They do this in Vegas, too?

MARISSA: (checking he's secure) They do everything in Vegas.

She grabs his pants off the floor and starts to head out --

MARISSA: Okay, I've gotta go change...

TREVOR: But you're wearing a costume... (realizing) Hey! You crazy bitch --

But Marissa is already out the door. Slams it.

The doors open and three cops exit. Followed by... Sandy, who's talking to the fourth cop. Who's accompanying... Seth.

SANDY: You're not asking him any questions without me present --

COP: You his lawyer?

SANDY: I'm his father.

Seth sees Ryan, locks eyes with him as he's guided into the back of the squad car. Ryan runs over --

RYAN: (to Sandy) What happened?

SANDY: There's been a fire at the Newport Group. They think it's Seth who set it.

Ryan and Sandy share a look and watch as the squad car drives off, Seth's head pressed against the window...

SLAP! Before she even knows what she's doing, Julie's raised her hand to her. Immediately regrets it.

JULIE: Marissa... Honey I'm sorry, I...

But it's too late. Marissa reacts, her eyes dead. She grabs her bag off the bed and exits, slamming the door behind her. Off Julie -- what has she done?

INT. NEWPORT HOSPITAL - WAITING ROOM -- NIGHT (N2)

Kirsten sits alone. Seth enters. Coffees in hand. She's clearly been crying.

SETH: Hey, Mom... Thought you could use a caffeinated pick-up.

KIRSTEN: Thanks, sweetie.

Seth sits down next to her. He puts an arm on her back.

SETH: Dad's gonna be okay.

KIRSTEN: I hope so... I should've known what the job did to my father, it would do to him.

SETH: It took Grandpa thirty years of backhanded deals and subterfuge to have a heart attack... (off Kirsten) Dad's tough. He'll pull through.

Dr. Spitz (40s) comes through the hospital doors. Stressed.

KIRSTEN: Doctor -- hi -- Kirsten Cohen.

DR. SPITZ: Yes, hello, Kirsten.

KIRSTEN: My husband -- Sandy -- is he out of surgery?

Dr. Spitz takes a moment. Looks from Seth to Kirsten. Seth suddenly has a bad feeling about all of this.

DR. SPITZ: Maybe we should talk privately?

SETH: Wait. A private talk -- what does that mean?

KIRSTEN: Just wait here, Seth. Okay?

Kirsten follows Dr. Spitz. Off Seth -- freaked out.

INT. HOSPITAL - CORRIDOR -- MOMENTS LATER (N2)

Dr. Spitz puts a hand on Kirsten's arm.

DR. SPITZ: Sorry if that was uncomfortable. But I think you should be the one to bring your son into this situation.

KIRSTEN: (trying to stay strong) Right. Of course. So what is it, exactly? The situation...

DR. SPITZ: The heart attack resulted in some permanent systemic damage. (off her look) Not just respiratory but neurological as well.

KIRSTEN: So... what does that mean for his recovery?

DR. SPITZ: (the hard part of the conversation...) Right now he's on full life support. His body can't function without the machine.

KIRSTEN: Right, I see...

But she doesn't see. Can't hear this news for what it is...

DR. SPITZ: Mr. Cohen has a living will on file with the hospital. (off her nod, gently) It has a "Do Not Resuscitate" order attached. Do you understand what that is...?

Off Kirsten -- yes, she does. But what is he saying...?

INT. YACHT CLUB -- NIGHT (N2)

Summer comes around a corner stealthily, Taylor behind her. Spots Dr. Roberts, back to them.

SUMMER: There he is, four o'clock.

TAYLOR: Yeah. And see... he's eating alone. There's no mystery woman. (off Summer) Usually I'd be right there with you, Sum. No one likes une liaison dangereuse more than me. But as you can see, the big fella's all by his lonesome.

Summer nods -- guess she was wrong after all. But just then, Dr. Roberts rises as a beautiful woman (late 30s) joins him at his table. Summer reacts... Ho-ly s***.

TAYLOR: Okay... so there's a mystery woman.

SUMMER: That's no mystery. I know exactly who that is.

Taylor turns to her for more of an explanation, but Summer is already crossing to their table.

RYAN: I want my kid. Now. Where is he?

THERESA: It's okay, Ryan, he's safe --

Eddie's pal takes his side. Intimidating. But Ryan doesn't back down.

RYAN: No, but my son is. And I'm not leaving 'til I know where he is.

THERESA: (quietly, broken) Ryan... I can't... I'm sorry... He'll...
